The overarching aim of the database is to survey the use of foreign precedents (foreign cases) by judges presiding in constitutional cases in the Constitutional Court of South Africa.
This project uses empirical data that employs both quantitative and qualitative indicators to achieve two purposes. The first is to determine to what extent foreign case law is cited by constitutional judges, and the second is to investigate the reliability of studies that describe and report instances of so-called “transjudicial dialogue” between courts.
